Terms of Use and End User License Agreement

This End-User License Agreement (“EULA”) outlines the agreement between you and SportsLog (the “Owner”) regarding the SportsLog mobile application (the “Software”). When you install, access, or use the Software, you agree to be bound by the terms and conditions set forth in this EULA. If you do not accept these terms, please do not install, access, or use the Software.

​Terms of Use

By using the Software, you affirm the following:

  • You are not located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist-supporting" country.

  • You are not listed on any U.S. government list of prohibited or restricted parties.

License

The SportsLog Software is licensed, not sold. The Owner grants you a non-exclusive, non-transferable, non-sublicensable, limited right and license to use the Software for your personal, non-commercial use.

​The rights granted here are dependent on your compliance with the terms and conditions outlined in this EULA. You acknowledge that no title or ownership in the Software is being transferred or assigned to you, and this EULA should not be seen as a sale of any rights in the Software.

​Restrictions of Use

  • Unless explicit written permission is obtained from the Owner, you are strictly prohibited from:

  • Reproducing or distributing copies of the Software.

  • Decompiling, reverse engineering, disassembling, incorporating into other software, or translating the Software.

  • Using the Software for any commercial objectives or purposes.

  • Modifying, altering, changing, or creating derivative works based upon the Software.

  • Renting, leasing, reselling, sub-licensing, assigning, distributing, or otherwise transferring the Software or this license. Any such attempted transfer shall be null and void.

Copyright

You acknowledge that no intellectual property rights in the Software are transferred to you under this EULA. You further acknowledge that all title and full ownership rights to the Software remain the exclusive property of the Owner, and you shall not acquire any rights to the Software. You must not remove or obscure the Owner's copyright, trademark, or other proprietary notices from any materials contained in the Software.

​Disclaimer of Warranty

The Software is provided "AS IS", without any warranty. The Owner disclaims and makes no express or implied warranties. The entire risk regarding the quality and performance of the Software is with you. The Owner does not warrant that the functions contained in the Software will meet your requirements or that the operation of the Software will be error-free.

​Limitation of Liability

The Owner will not be liable for any special, incidental, indirect, or consequential damages arising out of or in connection with your possession, access, use, or inability to use the Software. This includes, without limitation, damages to property, loss of goodwill, device failure or malfunction, and—where legally allowed—personal injury, property damage, or punitive damages, regardless of the form of action (whether in tort, contract, strict liability, or otherwise), and even if the Owner was advised of the possibility of such damages.

​Certain jurisdictions may not permit the exclusion or limitation of liability for specific types of damages. Accordingly, the above limitations will apply to the fullest extent permitted by law in the applicable jurisdiction. This limitation shall not apply where prohibited by law, including where federal, state, or local laws preclude such limitations.

​In any event, and except as otherwise mandated by law, the Owner’s total liability for any claim arising out of or relating to this EULA or the Software shall not exceed the amount actually paid by you for the Software.

​Privacy

​Indemnity

You agree to indemnify, defend, and hold harmless the Owner from and against all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (i) your use or misuse of the Software in violation of this EULA; or (ii) your breach of any term or condition of this EULA.

​Changes

The Owner reserves the right to revise or update these Terms at any time, at its sole discretion. Any changes to the Privacy Policy will be published on sportslogapp.com. You are responsible for reviewing this source periodically to remain informed of any updates or modifications.
